General Terms and Conditions for Use of and Electronic Purchasing from the Website www.bestCPAP.eu

Definitions:

  • bestCPAP – refers to Makantiz Ltd., UIC 207818801, with its headquarters in Bulgaria, Burgas, zh.k. Lazur 166, phone: +359887021244, email: [email protected], website: bestcpap.eu.
  • General Terms or GTC – refer to these General Terms and Conditions for shopping electronically from the Internet site www.bestCPAP.eu.
  • E-Shop – refers to the online store managed by Makantiz, located on the Site/domain www.bestCPAP.eu, through which Makantiz provides goods or services for payment.
  • Site – refers to the website located at www.bestCPAP.eu.
  • Consumer – refers to any natural person who acquires goods or uses services offered at the Internet Store not intended for commercial or professional activity.
  • Product – refers to a product or service provided by Makantiz and available for purchase by Users in the Internet Store.
  • Hygiene Products – refers to products that are factory-sealed by the manufacturer and cannot be returned to Makantiz for reasons of hygiene or health protection.
  • Contract – refers to the distance contract between Makantiz and the User for the purchase and sale of goods and/or services through the online store, which includes the present General Terms and Conditions, along with all other accompanying documents.
  • Durable medium – refers to any medium that enables the User or the merchant to store information sent to them personally, allowing its easy use in the future for a period consistent with the purposes for which the information is intended, and allowing unaltered reproduction. Examples include paper, USB storage devices, CD-ROMs, DVDs, memory cards, hard disks, email, and others.
  • Disclaimer Form – refers to the form used to exercise the right of withdrawal from the Agreement, available on the Site, and which is Appendix 2 to the General Terms and Conditions.
  • Privacy Policy – refers to the Privacy Policy available on the Site.

Subject to the General Terms and Conditions

  1. This document outlines the General Terms and Conditions under which Makantiz provides services and products to its Consumers through the Internet Store. The User explicitly agrees to these Terms and Conditions by using the Site and the Internet Store. If you disagree with any part of these Terms and Conditions, do not use this site.
  2. Makantiz reserves the right to update and amend these General Conditions periodically to reflect any changes in how the online store operates, the conditions, or any legal requirements affecting the trader’s activities. The updated version of the Terms of Service becomes applicable from the moment it is posted on the Site. The General Terms and Conditions that were in force at the time of the conclusion of the distance contract between Makantiz and the User apply to each Contract.
  3. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will still be valid.
  4. The present General Terms and Conditions do not apply to contracts concluded between Makantiz and Users in Makantiz’s commercial locations.

Personal Data

  1. Makantiz will process personal data only as specified in Article 2 of these Terms, unless otherwise agreed. In cases specified by law, Makantiz may process and store personal data for legal compliance purposes.
  2. Makantiz will only disclose personal data to the third parties listed below unless additional consent for the transfer of personal data is provided by the User. Makantiz will take appropriate measures to ensure personal data is processed, protected, and transferred in compliance with applicable law.
  3. Makantiz may engage other companies or individuals to perform certain tasks related to the services provided, such as website support or delivery services, including postal operators, freight forwarders, and other subcontractors.
  4. Personal data will only be shared with external service providers to the extent necessary for specific purposes. These service providers are contractually bound to ensure the confidentiality of personal data.

Consent

By clicking the Order button, the User declares that they have read, understood, and fully agree with these Terms and Conditions.

  1. Terms of Order for Goods
  • Purchase Order

The delivery of goods from the online store is initiated after an order is placed for a product via the Site. The order requires the User to specify their preferred payment method and a contact phone number. Upon acceptance, any valid order made by the User will receive a service number and a confirmation of acceptance.

  • Confirmation and Execution of Orders

Makantiz will confirm or decline orders via phone or email. Makantiz reserves the right to not fulfill an order if the customer’s data is invalid, incomplete, or incorrect. Makantiz will notify the User of this using the provided contact information.

Order confirmation occurs within the working day if placed before 15:00 EET, and on the next business day if placed after 15:00 EET. Orders placed on non-working days will be confirmed on the next business day. Confirmation of the order will be sent to the User via a durable medium.

The User may cancel or modify the order before confirmation by Makantiz’s operator. If canceled, any payments made will be refunded to the User.

  • Taxes and VAT

All product prices listed on the Site including VAT.

  • Distance Sales Contract

The contract between Makantiz and the User is considered concluded once the User receives Makantiz’s confirmation of the order.

The Agreement includes all relevant documents, such as the order, confirmation, and other accompanying documents, including these General Terms and Conditions.

Time and Cost of Delivery

Delivery of goods in stock ordered from the online store will occur within 10 working days within the EU (excluding Malta and Cyprus), and between 7 and 14 working days for orders outside the EU. Free shipping is offered for all EU countries for orders over 200 Euros. Delivery costs for orders under 200 Euros or shipped outside the EU will be calculated according to the tariffs of courier companies such as DHL or others.

In case of a delivery delay, Makantiz is obligated to inform the User of the new delivery date.

Terms and Methods of Payment

Makantiz supports most popular electronic payment methods within the EU, including bank transfer, Visa, MasterCard, and PayPal. The User will select their preferred payment method during the order process.

Makantiz is not liable for any additional charges incurred by the User’s bank or for currency exchange fees when payments are made in a currency other than EUR.

Return Policy

  1. The Consumer is entitled to return goods purchased from the Internet store without penalty, within 30 days of receipt, in accordance with the Electronic Commerce Act and the Consumer Protection Act. The full purchase price will be refunded. The return is subject to the following conditions:
  • The return request must be made in writing by email to [email protected] within 30 days after receipt of the goods.
  • The goods must be in original, unopened packaging with all labels and original documents (e.g., invoice, receipt, warranty card).
  1. The User must return the goods to Makantiz without undue delay and no later than 30 days after purchasing the product.
  2. The Consumer is liable for any reduced value of goods caused by unnecessary testing, other than to establish the product’s nature, characteristics, and functionality.
  3. The Consumer bears the direct cost of returning the goods.
  4. The right of withdrawal and return of goods does not apply to:
    • Special orders tailored to individual customer specifications.
    • Sealed hygiene products, such as CPAP masks.
  5. Makantiz may refuse a refund if the conditions for the return of goods are not met.
  6. Refunds will be processed within 14 days of Makantiz receiving the User’s withdrawal request and goods, using the same payment method initially used by the User.
  7. Refunds will not include additional shipping costs if the User selected a delivery method other than the cheapest standard option.
  8. Detailed information on exercising the right of withdrawal is provided in Appendix 1.
  9. Makantiz reserves the right to refuse returns for items delivered outside the European Union.

Complaints, Objections, and Recommendations from Users

  2. Requests must include the User’s contact details and a description of the issue. Anonymous requests will not be processed.
  3. Makantiz will review complaints and provide a written response within one month.

Warranties and Post-Warranty Service

  1. Consumers may claim goods that are not in conformity with the sale contract, requesting Makantiz to bring the goods in line with the contract.
  2. Claims must be made within two years from the goods’ delivery date.
  3. Makantiz is not responsible for defects caused by improper use or external factors (e.g., physical, chemical, electrical damage) or defective consumables.

  5. CPAP Masks Warranty: Makantiz provides a standard 90-day warranty for most CPAP masks against factory defects.
